TERMS AND CONDITIONS GIFTING SITE
These terms and conditions apply if you use the gifting hub (Gifting Hub) operated by Endeavour Group Limited trading as Dan Murphy’s (Dan Murphy’s), including if you purchase a gift (a Purchaser) or if you are a recipient of a gift (a Recipient).
1. Overview of the Dan Murphy’s Gifting Hub
The Gifting Hub allows a Purchaser to purchase products from the Dan Murphy’s website or mobile app for delivery to nominated Recipients. Recipients will be notified that an order has been placed for them and will be asked to confirm their delivery address. Once confirmed, the gift will be delivered to each Recipient.
Dan Murphy’s operates the Gifting Hub as agent for The Trustee for Shorty’s Liquor CBD Pty Limited ABN 44 036 395 077 (Shorty’s) under Shorty’s liquor licence. Shorty’s will issue the tax invoice to the Purchaser for orders placed on the Gifting Hub and is responsible for accepting, processing and fulfilling orders on the Gifting Hub. 2. Purchasing Gifts
a. By placing an order on the Gifting Hub, the Purchaser confirms that they, and each Recipient, is over the age of 18.
b. Dan Murphy’s Gifting Hub will notify each Recipient that they have a gift available using the contact details provided by the Purchaser. It is the Purchaser’s responsibility to ensure that the correct information is provided for each Recipient at the time of order. To the extent permitted by law, no refunds will be provided where incorrect Recipient information is supplied.
c. The Purchaser can view the redemption status for each Recipient on the Gifting Hub. It is the Purchaser’s responsibility to remind or prompt Recipients to redeem the gift.
3. 3. Redeeming Gifts / Donation by Shorty’s to Charity
a. The Recipient will receive a notification email (using the details provided by the Purchaser) from Dan Murphy’s Gifting Hub that they have a gift available to be redeemed.
b. Gifts must be redeemed by Recipients within three months of the date of the notification email. The Recipient can either:
i. redeem the gift by providing their delivery address to the Gifting Hub; or
ii. forego receiving the gift and authorise Shorty’s to donate the price
(including delivery fee) for the gift to charity. If the Recipient does not take either of the actions in paragraph 3(b) within 3 months of the notification email, the Recipient will be deemed to have surrendered the gift and Shorty’s will donate the price (including delivery fee) of the gift to its nominated charity. When Shorty’s donates the price of a gift to charity, it does so to GIVIT Listed Ltd or such other charity as indicated in the notification email and/or Gifting Hub. The donation is made by Shorty’s, and neither the Purchaser nor the Recipient will receive a receipt for the donation. Recipients can only redeem each gift once. Gifts are not transferable and not redeemable for cash.
4. Product Availability
If a gifting product is unavailable, Shorty’s may substitute it with a product of a similar type and with equal or greater value.
5. Returns Policy
The Shorty’s Refund & Return Policy applies to products purchased from the Gifting Hub.
Every effort is taken to ensure that products are described as accurately as reasonably possible. However, due to natural variations, aged wine (15 years and older) may have characteristics (including taste, ullage, cork/label condition) that can significantly differ from the characteristics that it had when it was young. Please expect these natural variations to be present before purchasing aged wine.
Important Disclaimer: Purchases made on Dan Murphy’s Gifting Hub cannot be returned/exchanged in Dan Murphy’s stores.

Who do we collect personal information from?
We collect personal information from customers and gift recipients. Personal information collected from customers and gift recipients includes your name, address, email address, date of birth, mobile/phone numbers, payment details, and ABN details (if any).
What are the purposes of collecting your personal information?
The primary purpose of collecting personal information from our customers is:
to perform administrative functions;
to communicate with you about your purchases (including via surveys and product reviews which may be published on through our website or mobile applications);
to seek customer feedback from you (including via surveys and product reviews) and to publish feedback provided;
for marketing purposes;
for business improvement purposes;
to keep our records accurate and up-to-date;
to respond to your enquiries and complaints; and
to comply with our legal obligations.
Information collected from gift recipients will only be used to perform administrative functions and to respond to any of their enquiries or complaints.
When do we collect your personal information?
We generally collect personal information from our customers when you shop with Dan's Gifting Hub. This includes information about your transaction and browsing history (such as items purchased, the price of those items, the date of purchase).
Information about gift recipients is collected at the time it is provided by our customers.
Does Dan's Gifting Hub collect personal information from third parties?
We may, from time to time, also collect personal information for related businesses. This is done to provide you with our great products and services.
In order to process gifting orders, Dan's Gifting Hub collects the personal information that is required to process the relevant orders and provide the intended recipient (“Recipient”) with the gift/s.
Recipients’ personal information collected from customers is limited to the Recipient’s contact details (including email address and phone number), which are required to notify the intended Recipient of the relevant gift. In order to process orders and deliver the gifts purchased for Recipients, Shorty’s will collect the Recipient’s name, address, email address, and date of birth (where required) directly from Recipients. Customer's names are disclosed to Recipients to allow them to identify the origin of the gift.
The primary purpose of collecting the Recipient’s personal information is to process gift orders and provide notification that the relevant gift has been purchased to the intended Recipient.
Information about gift recipients is collected at the time it is provided by our customers and Recipients.
If customers and/or Recipients do not provide us with the required personal information, it may be impossible to process the gift order.
Recipients’ personal information will only be used to perform administrative functions associated with fulfilling the relevant order and to respond to any enquiries or complaints.
Videos and Messages
Customers and Recipients are able to provide messages (including video messages) to each other, including through the use of a designated Youtube or Vimeo account. These entities have their own privacy policies and terms of service, which can be reviewed here (https://policies.google.com/privacy?hl=en-G; https://vimeo.com/privacy#protecting_your_information). By agreeing to purchase or receive a gift, you agree that Dan's Gifting Hub assumes no responsibility for the content included on these platforms, and that you will not include information relating to any individual’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, details of memberships to professional or trade associations/trade unions, sexual preferences or practices, or criminal record in these messages.
Note that all video messages will be deleted 30 days after being uploaded, regardless of whether they have been viewed or not.
Do we collect personal information under a law or order?
We collect personal information of our customers under various laws. These include taxation laws, corporations law (for example relating to our shareholders), anti-money laundering laws and privacy laws. We may also collect personal information if we are required or authorised to do so by a court/tribunal order.
What happens if we are unable to collect your personal information?
If you do not provide us with the required personal information, it may be impossible for us to provide you (or the gift recipient) with our products or services.
How do we disclose personal information?
Disclosure to others
We disclose the personal information we collect about our customers and gift recipients to other persons and entities.
For example, we disclose personal information to:
our service providers (including to our information technology and marketing service providers) to assist us in carrying out our functions and activities ;
to our related businesses; or
to regulators or courts for compliance with the law or otherwise as legally appropriate.
We are not likely to disclose personal information about our customers to overseas recipients.
Can we change our Collection Statement?
We may change the terms of our Collection Statement from time to time. A copy of the revised Collection Statement will be available on our website.
